Licensing Terms and Conditions
Copyright – Short
file4sale.com is a part of 4selection.com a Danish company based in Denmark. All legal matters related to this website, its content, and its services are governed by Danish law.
All creative content made available on file4sale.com – including but not limited to music, lyrics, melodies, text, spoken word, photos, and videos – is the sole intellectual property of file4sale.com and its creators. This content is protected by both Danish and international copyright laws, including the Berne Convention and the EU Copyright Directive.
Ownership and Copyright
All files offered by file4sale.com are automatically protected by copyright from the moment of creation. Ownership of the original works remains exclusively with file4sale.com unless a separate, individually signed agreement explicitly transfers those rights.
Purchasing a file does not transfer ownership of the original content. Instead, it grants a limited licence to use the file under the conditions defined below. No file may be copied, shared, resold, or distributed without written permission from file4sale.com or in accordance with a valid purchase and usage licence.
Licensing Upon Purchase
Upon confirmed and completed payment, the buyer receives a non-exclusive, non-transferable licence to use the purchased file for their own legal purposes. This licence covers the use of the file in commercial or non-commercial contexts, depending on the licence level selected at checkout.
The licence is valid only for the individual or legal entity that completed the purchase. It may not be sublicensed, transferred, assigned, sold, or shared in any way with third parties.
Unless a custom agreement is made, all standard sales are non-exclusive, and the file may still be available to other buyers.
Restrictions on Resale and Redistribution
You are strictly prohibited from: Reselling or sublicensing any file purchased from file4sale.com. Sharing or distributing the file (or altered versions of it) with any other person, platform, or service. Uploading or offering the file on any third-party website, streaming platform, or marketplace. Claiming authorship or falsely attributing the content to yourself or your organisation. These actions violate both Danish and international copyright law and may result in legal action, including financial damages and the removal of unauthorised content.
Modification and Derivative Works
You may not modify a file in such a way that implies original authorship or removes attribution to file4sale.com unless explicitly agreed in writing.
If you incorporate the content into a larger project (e.g. a podcast, short film, marketing video, or digital product), you may do so under the terms of your licence. However, this does not entitle you to repackage or distribute the original or modified content as your own product.
Significant modifications do not change the fact that the original file remains the copyrighted property of file4sale.com.
Refunds and Access Rights
All sales are final. Because digital files are instantly delivered and reproducible, we do not offer refunds once a download has occurred or access has been granted.
If technical issues prevent delivery, file4sale.com will make reasonable efforts to resolve the issue and ensure you receive what you paid for.
If a payment is revoked, refunded, or reversed after delivery, all rights to use the file are automatically voided, and you must delete any copies in your possession.
Legal Jurisdiction and Enforcement
All legal relations, claims, and disputes related to file4sale.com are subject to the laws of the Kingdom of Denmark.
Any legal disputes arising from licensing, use, distribution, or resale of content shall be handled exclusively by the courts of Denmark. file4sale.com reserves the right to take legal action against unauthorised use, including but not limited to copyright infringement, contract violations, and unlawful redistribution.
Changes and Updates
file4sale.com reserves the right to amend these terms and conditions at any time without prior notice. The most recent version will always be available on this page (frames.file4sale.com).
By purchasing or using any content from file4sale.com, you acknowledge that you have read, understood, and agreed to these terms.
Any legal proceedings cannot be transferred to another jurisdiction or country.
Exclusivity and Licensing of Files
At file4sale.com, we offer two distinct types of files to accommodate different client needs. Some files are custom-made, created exclusively to fulfil the unique requirements of an individual client. These bespoke files are tailored specifically for that client’s use and are sold only once, ensuring exclusivity and preventing any other party from obtaining the same file.
In contrast, we also provide files that are not exclusive, meaning they are part of our general catalogue and available for purchase by multiple clients. These standard files are developed for broader use and may be sold to any number of buyers without limitation.
For transparency and clarity, each file listed on our platform will include information clearly indicating whether it is exclusive or non-exclusive. This allows clients to make informed decisions based on their preferences for exclusivity, licensing, and intended use.
An exclusive file is one that has been developed specifically for a single client, often based on the client’s individual preferences or requirements. When a client purchases an exclusive file, they acquire the right to use that file without competition or duplication, as it will not be sold, shared, or made available to any other party. The client does not obtain ownership of the original intellectual property, but they are granted a non-transferable licence for exclusive use. The exclusivity ensures that no other customer will legally be able to access, download, or purchase the same content from file4sale.com at any point in the future.
A non-exclusive file, by contrast, is a pre-existing or standard file that has not been developed for a particular client and is not limited to a single purchase. Non-exclusive files may be purchased by multiple clients and are not subject to exclusivity agreements. Buyers of non-exclusive files are granted a licence to use the file, but they understand and accept that others may legally purchase and use the same content for their own purposes. These files are typically part of our general collection or product catalogue and are suitable for broad usage scenarios.
